2016 Rules Govern ASI-Executive Promotions

The Supreme Court allowed the civil appeal and set aside the Calcutta High Court’s judgment in the dispute over promotion to the post of ASI-Executive in the Andaman and Nicobar Police Department.
The parties were Head Constables in the Union Territory Administration. The controversy arose from the shift in recruitment rules over time, especially the move from a selection-based process to a non-selection promotion regime. The Court traced the evolution of the applicable framework, including the 2008 Rules, the 2010 Rules, and the amended 2016 Rules.
The central issue was whether promotions to ASI-Executive had to be governed by the earlier selection process or by the 2016 Recruitment Rules. The Court noted that the 2016 Rules changed the method to 100% promotion on a seniority-cum-fitness basis and removed the earlier selection test and matriculation requirement.
The Court held that the impugned judgment could not stand. It reasoned that the law in force at the time of consideration applies to filling vacancies or promotional posts. On that basis, the Court concluded that the relevant consideration for promotion took place under the 2016 Rules. It also observed that some promotions had already been made pursuant to the 2016 circular and that those promotions were not in issue in the original application.
The Court further held that the eligible candidates, including the appellants and respondents, must have their cases considered strictly in accordance with the 2016 Rules. It directed the Administration to fill the existing vacancies of ASI-Executive under the 2016 Rules within two months from the date of judgment.
For service law practice, the ruling reinforces that where recruitment rules are amended before the actual consideration of vacancies, the amended rules will ordinarily govern the process unless a contrary legal position is shown.
Practical takeaway: promotional vacancies must be filled under the rules in force at the time of consideration, here the 2016 seniority-cum-fitness regime.
