ATPL Suspension Quashed for Procedural Non-Compliance

The Bombay High Court quashed the DGCA’s order dated 12 March 2011 suspending the petitioner’s Airline Transport Pilot Licence. The Bench of Justice Manish Pitale and Justice Shreeram Vinayak Shirsat held that the impugned action could not stand because the statutory procedure under Rule 39A and Rule 19 of the Aircraft Rules, 1937 had not been followed.

The petitioner had obtained a Commercial Pilot Licence, later secured an ATPL, and had also undergone renewal checks. The suspension came after a criminal complaint and allegations that the ATPL had been obtained on the basis of forged documents. The DGCA defended the suspension on the ground that the petitioner had furnished incorrect information and that immediate action was necessary in the interest of public safety.

The court examined the material relied upon by the DGCA and found that the order suffered from legal infirmity. It held that the respondent had not adhered to the procedure mandated by the Aircraft Rules and the relevant enforcement policy. The judgment records that there was a clear infraction of Rule 39A and Rule 19, and non-adherence to Clause 12.7 of the Enforcement Policy and Procedures Manual. On that basis, the court concluded that the suspension order was illegal and unsustainable.

The court also restored the ATPL issued to the petitioner. At the same time, it preserved the DGCA’s authority to proceed afresh, but only by following the procedure laid down under Rule 39A, giving the petitioner an opportunity of hearing, and passing a reasoned order. The fresh inquiry was directed to be completed expeditiously within two months.

The practical point is straightforward: even where aviation regulators act on allegations of forged credentials or public safety concerns, the action must still comply with the governing statutory procedure and principles of hearing before a licence is suspended.
