Uncommunicated ACRs and HAG promotion

The Supreme Court examined a challenge to denial of promotion to Chief Medical Director in the Higher Administrative Grade under the Indian Railway Medical Service. The appellant had been denied promotion after the Selection Committee assessed her record against a benchmark of VG+, and the Tribunal as well as the Delhi High Court upheld that decision.

The appellant argued that the wrong benchmark had been applied. She relied on the DoPT Office Memorandum dated 08.02.2002, which prescribed a benchmark of “Very Good” and stated that any conflicting office memorandum would stand modified to that extent. She also contended that adverse entries in her Annual Confidential Reports were never communicated to her, depriving her of an opportunity to represent against them. The service records were not produced before the Court, and the Court drew an adverse inference against the respondents on that account.

The Court held that the appellant was not fairly treated while her case for promotion was assessed. On that basis, it set aside the judgments of the Tribunal and the High Court. The Court held that she was entitled to notional promotion in the HAG grade of ₹22,400-24,500 and to pensionary benefits in that grade.

At the same time, the Court declined to grant arrears of salary from the notional date of promotion till superannuation. It reasoned that, since the service record was not available for perusal and an adverse inference had been drawn against the respondents, refixation of pension in the HAG grade would meet the ends of justice.

The appeal was allowed, and the Court directed payment of the consequential benefits within two months.

Practical takeaway: In promotion disputes, uncommunicated ACR entries and an incorrect benchmark can vitiate the assessment, but monetary relief may still be limited to notional promotion and pensionary benefits.
