Unrelated Bail Order Cannot Support Preventive Detention

The Madurai Bench of the Madras High Court quashed the detention order passed under the Tamil Nadu Act 14 of 1982 against Sai Sudhahar @ Sudhahar. The petition was filed by his wife under Article 226 challenging PD No.50/2025 dated 07.10.2025, by which he had been detained as a “Goonda” and lodged in Central Prison, Trichy.

The core challenge was to the detaining authority’s satisfaction that there was a real possibility of the detenu coming out on bail. It was undisputed that no bail petition was pending on the date of the detention order. The authority nevertheless relied on an earlier order dated 24.05.2023 in Crl.O.P.(MD) No.9486/2023 to conclude that bail was likely.

The Court examined the preventive detention standard applicable to a person already in custody. It referred to the settled position that the authority must be aware of custody, must have reliable material to believe there is a real possibility of release on bail, and must also be satisfied that on release the detenu would likely indulge in prejudicial activity. The Court also noted the reliance placed by the State on the Supreme Court decisions in Ankit Ashok Jalan and Dimple Happy Dhakad, which in turn restate the Kamarunnisa principle.

On facts, the Court found the reliance on the earlier bail order legally insufficient. The earlier case involved a single complainant, whereas the present detention was based on 230 complaints involving alleged transactions worth about Rs.13 Crore. The Court held that a bail order passed in a materially different case could not be treated as a similar case for the purpose of drawing a conclusion that the detenu would likely be released on bail. The subjective satisfaction recorded by the detaining authority was therefore not supported by cogent material.

The Court held that this amounted to non-application of mind. On that ground, the detention order was quashed and the detenu was directed to be released forthwith unless required in connection with any other case.

Practical takeaway: in preventive detention matters, a prior bail order can support detention only if it is genuinely comparable on facts and material.
